Terms of Use

NOVERIX has created and maintains the noverix.com website ("the Site") in order to provide the public with on-line information and resources concerning the NOVERIX data centre campus. By using the Site and its content, the user expressly agrees to comply with, and be bound by, the following terms, which NOVERIX may change at any time.

Terms and conditions

All of the texts, images, marks, logos, service marks and other content of the Site are proprietary to NOVERIX and are to be used in a manner consistent with NOVERIX's permission or applicable laws and regulations. NOVERIX authorises users to view, download and print content from the Site upon the following conditions: (1) users must observe any and all additional terms or restrictions provided within individual sections of the Site related to particular content of the Site; (2) unless otherwise restricted, users may only view, download and print content from the Site for their own personal and non-commercial use, or for fair use as defined under applicable copyright laws; (3) downloading content from the Site for commercial use or for use on a personal website is strictly prohibited; (4) users may not remove any copyright, trademark, service mark or other proprietary notice that has been placed in or near the content on the Site by NOVERIX; (5) users may not modify the appearance or content of the Site; and (6) any displays or printouts of the Site's content must be marked "© [year of display or printout] Noverix. All rights reserved." If a user downloads, prints or uses content from the Site in any manner, the user represents and warrants that the use will be consistent with this licence, that the user will not infringe or violate the rights of any other party, and that the use will not breach any contract with, or legal duty to, any other parties.

Permissions and requests for images and other Site content

Except as expressly permitted above, reproduction or redistribution of any content on the Site is strictly prohibited without the prior written permission of NOVERIX. To request permission to use or reproduce images, or to publish or quote from the Site — including professional journalists who wish to obtain any portion of the Site's content for publication — please contact info@noverix.com. NOVERIX reserves the right not to grant permission to use the content of the Site, and does not grant permission to use materials of third parties.

No representations or warranty

NOVERIX makes no representation of any kind regarding the content of the Site. All contents on the Site are provided "as is". NOVERIX expressly disclaims any and all warranties of merchantability or fitness for a particular purpose. Without limiting the foregoing: (1) NOVERIX does not warrant or represent that use of content displayed on the Site will not infringe the rights of third parties not owned by or affiliated with NOVERIX; copyright and other proprietary rights in the Site's content may be held by individuals and/or entities other than NOVERIX, and use of such content by the user is prohibited unless specifically permitted by these Terms of Use. (2) While NOVERIX uses reasonable efforts to include accurate and up-to-date information on the Site, NOVERIX makes no representations or warranties as to its accuracy, and assumes no liability or responsibility for any errors or omissions in the content of the Site. (3) Use of and browsing on the Site is at the user's risk. NOVERIX assumes no responsibility and will not be liable for any damage to, or viruses that may infect, the user's computer equipment or other property on account of the user's access to, use of, browsing in, or downloading of any content from the Site.

Except where specifically indicated otherwise, any communication or material the user transmits to the Site by electronic mail or other means, including any data, questions, comments, suggestions or the like, will be treated as non-confidential and non-proprietary, and may be used by NOVERIX and its respective affiliates or licensees for any purpose.

The Site may contain links to third-party sites. NOVERIX has not reviewed all of the sites linked to the Site and is not responsible for the content of any linked site. NOVERIX provides these links as a convenience only, and such links do not imply NOVERIX's endorsement or sponsorship of, or affiliation with, the linked site.

Content provided by users

Although NOVERIX may from time to time monitor or review discussions, postings and transmissions on the Site, NOVERIX is under no obligation to do so and assumes no responsibility or liability arising from the content of any such locations, nor for any error, defamation, libel, slander, omission, falsehood, obscenity, profanity, danger or inaccuracy contained in any information within such locations on the Site. Users are prohibited from posting or transmitting any unlawful, threatening, libellous, defamatory, obscene, scandalous, inflammatory, pornographic or profane material, or any material that could constitute or encourage conduct that would be considered a criminal offence, give rise to civil liability, or otherwise violate any law. NOVERIX will fully cooperate with any law enforcement authorities or court order requesting or directing NOVERIX to disclose the identity of anyone posting any such information or materials. Rights and reproductions

For permission to use photographic or video material from the Site for publication, please e-mail info@noverix.com.

Indemnity

The user agrees to indemnify, defend and release NOVERIX, and each of its respective trustees, officers, employees and agents, from all claims, causes, allegations, costs, expenses, fees (including actual attorneys' fees), judgments, liabilities, losses and damages arising from or relating to the user's use or operation of the Site (www.noverix.com).

Waiver

Any waiver of any provision of this agreement must be in writing and signed by an authorised representative of NOVERIX.
